Terms of Service

The Operations Checkpoint service (the "Service") is operated by US Launchpad s.r.o., with registered office at Pernerova 697/35, Karlín, 186 00 Praha 8, company ID (ICO): 06837115, tax ID (DIC): CZ06837115, registered in the Commercial Register kept by the Municipal Court in Prague, Section C, Insert 289878 (the "Provider").

These Terms of Service (the "Terms") govern the rights and obligations between the Provider and the user of the Service (the "User") in connection with use of the Service available at https://operations-checkpoint.operationshub.cz.

By registering an account or starting to use the Service, the User confirms they have read and agree to these Terms. If the User does not agree, they must not use the Service.

The Service is a SaaS software tool for the indicative self-assessment of regulatory compliance by businesses operating in the Czech market against selected legal regulations. It provides a structured questionnaire (audit), evaluation of answers, an indicative score, generated reports, and an accompanying chat assistant.

The outputs of the Service are for informational and indicative purposes only. They do not constitute legal advice, a legal opinion, or any guarantee of compliance. The Service does not replace consultation with an attorney, tax advisor, or other qualified professional.

The Provider may change, extend, or limit the scope, features, and content of the Service over time, in particular in response to changes in legislation.

Most features of the Service require registration and creation of a user account. The User must provide true and current information and keep it up to date.

The User is responsible for keeping their login credentials secure and for all activity under their account. Any suspected misuse must be reported to the Provider without undue delay at system@uslaunchpad.com.

The Service may only be used by persons over 18 years of age with full legal capacity. A User acting on behalf of a legal entity warrants that they are authorised to do so.

The Service is offered in a free tier with limited scope and in paid tiers (Base and Premium) purchased as a one-time payment. There is no subscription and no recurring billing. The current pricing is available within the Service.

Payments are processed by the payment service provider Stripe Payments Europe, Ltd. The Provider does not store the User's payment card details.

A one-time payment grants the User an entitlement which, once activated, unlocks the paid features for a limited period and a limited scope (number of audits) as specified within the Service. The entitlement does not renew automatically; once the period or scope is used up, the User may purchase an entitlement again. The amount paid is non-refundable unless stated otherwise (in particular the right of withdrawal under Section 5) or required by mandatory law.

All prices are stated including any applicable VAT unless stated otherwise.

If the User is a consumer, they have the right to withdraw from the contract within 14 days of its conclusion without giving a reason, in accordance with the Czech Civil Code.

The User expressly consents to the supply of digital content and services beginning before the withdrawal period expires; the User acknowledges they thereby lose the right of withdrawal to the extent of the performance already provided.

To withdraw, it is sufficient to send a notice to system@uslaunchpad.com.

The User agrees to use the Service in accordance with applicable law and these Terms. In particular, the User must not misuse the Service, disrupt its operation, attempt unauthorised access, scrape content beyond ordinary use, or use the Service for unlawful purposes.

The User is responsible for the accuracy and completeness of the data they enter into the Service. The Provider is not responsible for evaluation results based on incorrect or incomplete inputs.

All content of the Service, including software, text, questionnaires, design, and trademarks, is protected by law and is the property of the Provider or its licensors.

The User is granted a non-exclusive, non-transferable, revocable right to use the Service for the duration of the contractual relationship solely for its intended purpose. Reports generated by the User may be used for the User's own internal needs.

The Service is provided "as is". The Provider gives no warranty that the outputs of the Service will ensure the User's compliance with legal regulations, or that they are error-free, complete, or current.

The Provider is not liable for damage incurred by the User as a result of a decision made on the basis of the Service's outputs. The User acknowledges they should seek professional legal assistance before taking any step with legal or financial consequences.

To the extent permitted by law, the Provider's total liability is limited to the amount paid by the User for the Service over the last 12 months. This does not affect liability that cannot be excluded or limited by law.

The contractual relationship lasts for as long as the User's account exists. The User may delete the account at any time.

The Provider may suspend access to the Service or delete the account in the event of a breach of these Terms or the law, after prior notice, unless such notice would be impractical given the seriousness of the breach.

The Provider may amend these Terms. The User will be informed of any material change via the Service or by e-mail within a reasonable period before it takes effect. By continuing to use the Service after the change takes effect, the User agrees to it.

The contractual relationship is governed by the law of the Czech Republic, in particular the Civil Code. The courts of the Czech Republic have jurisdiction over disputes.

If the User is a consumer, they have the right to out-of-court resolution of a consumer dispute. The competent body is the Czech Trade Inspection Authority (www.coi.cz).
